I.General terms & conditions

1. Fundamental provisions

1.1. These terms & conditions apply to all contracts that you conclude with us, Niehoff Food GmbH, via the website www.pompongs.com.

1.2. A ‘consumer’ is a natural person who enters into a legal transaction for private purposes, i.e. not for commercial or professional purposes. An ‘entrepreneur’ is a person or company that enters into a transaction for commercial purposes

2. Conclusion of the contract

2.1. We sell goods to you via the website www.pompongs.com. Our offers are without obligation and do not constitute a binding offer.

2.2. You can place your order via our shopping basket system. Once you have added the desired products to your shopping basket, you can change them before you click on ‘order with obligation to pay’. As soon as you submit the order, you make a binding offer. You will receive an automatic confirmation email, but this does not yet constitute confirmation of the contract.

2.3. We will accept your order by email within 3 working days. If you do not receive a confirmation, you are no longer bound to your order. Should no contract be concluded, we will refund any sums already paid.

2.4. You will receive all the important information about your order by email. Make sure that your email address is correct and that you can receive our emails.

3. Right of retention, retention of title

3.1. You can only assert a right of retention if it concerns claims from the same contract.

3.2. The goods remain our property until payment has been made in full.

4. Warranty

4.1. The statutory warranty rights apply.

4.2. Please check the goods on delivery for completeness, damage or defects and notify us and the shipping company immediately if there are any issues.

5. Choice of law, place of performance, place of jurisdiction

5.1. This relationship is governed by German law. Your legal protection under the law of your home country remains unaffected.

5.2. The place of performance and place of jurisdiction is our registered office if you are an entrepreneur or do not have a place of residence in Germany or the EU.

5.3. The UN Convention on Contracts for the International Sale of Goods does not apply.

3. Contract language and storage of the text of the contract

3.1. The contract language is German.

3.2. We do not store the text of the contract. However, you can print or save the text before sending it. We will send you the order details and the general terms & conditions by email after you have placed your order.

4. Essential characteristics of the goods or service

The key information about the goods is detailed in the respective offer.

5. Prices and payment terms

All prices are inclusive of taxes.

5.2. Shipping costs are not included in the price, unless free shipping is offered. These will be displayed during the ordering process.

5.3. The payment methods available are listed on our website or in our offer.

5.4. The purchase price is payable immediately unless otherwise agreed.

6. Terms of delivery

6.1. The delivery conditions and delivery times are detailed on our website.

6.2. The risk of loss or damage to the goods is transferred to you as soon as you have received the goods.

7. Statutory liability for defects

If the goods have defects, you can report this to us. We are liable for defects that were already present at the time of delivery. The goods must be returned to us for inspection. If the defect is confirmed, we will refund the purchase price and the costs of returning the goods.

III. Withdrawal policy

1. Right to withdraw

You can withdraw from the contract within 14 days without stating a reason for doing so. This period begins:

on receipt of the last item, in the case of delivery of multiple items;
on receipt of the last instalment, in the case of delivery in multiple instalments.

To exercise your right of withdrawal, please notify us of this by email or letter. You can also use the template withdrawal form below.

2. Consequences of withdrawal

If you withdraw from the contract, we will refund all payments we have received from you, including delivery costs (except for more expensive forms of delivery than the cheapest standard option), no later than 14 days after receipt of the notice of withdrawal. We will reimburse you the amount using the same method used for the original payment.

We can refuse to issue the refund until we have received the goods back or you have provided us with proof of return shipment.

You must return the goods to us within 14 days. However, you must pay for the return shipping costs yourself. Please keep the tracking number so you can track the return.

The right of withdrawal expires if the goods have been opened and therefore cannot be returned for hygiene and health reasons.
